Commercial Rent Collection

The credit crunch has seen debts spiralling as people struggle to make ends meet with less expendable income. A bailiff uses tact and diplomacy when dealing with debtors and they each hold a Bailiff Certificate issued by a local County Court as well as a bond, which is required by law. Normally it is the last option available when a Certificated Bailiff is called to attend a property; the debtor will have been given plenty of time by the Landlord to come up with the money that they need to pay off their debts beforehand.

 

Certificated Bailiff's are able to Levy Distress in order to make a Debtor pay their outstanding rent, if the Debtor refuses to pay the Bailiff is able to remove and sell goods to discharge the debt owed to the Landlord

Lease Forfeiture

  

Everything runs smoothly for landlords until they get a tenant that doesn’t pay their rent on time. Sometimes they fail to pay their rent at all yet feel it is fine to still have occupancy of the building that they are renting.

 

If you are a landlord that has unwelcome tenants at your commercial property you could authorise a Lease Forfeiture warrant through our certificated bailiffs. The bailiffs can then effect a peaceable re-entry of the premises to secure a Lease Forfeiture.

 

Leases can easily be forfeited with a Lease Forfeiture warrant when a break clause is put into the original lease contract or assignment. Tenants that think they are being clever by not paying the rent will soon realise that this is not acceptable behaviour.

 

Once inside the property the locks can be changed and termination of lease notices can be displayed. We always undertake commercial lease forfeitures on a fixed fee basis.

·         We will book the Locksmith

·         We will call you back to give you the day and time forfeiture WILL take place

·         We will post to you via Recorded Delivery the new keys to the forfeited property once the Bailiff is finished.

 

Traveller Eviction

 

The expressions 'trespasser' and 'squatter' have the same meaning in Law and are interchangeable. A trespasser (squatter) is a party who enters onto, or remains on, property without lawful authority or permission from the party with an immediate right to occupation of that property.

 

Possession can be obtained in relation to all forms of commercial premises/private land without a court order, providing; the occupier is not a residential tenant (or a former residential tenant) of any part of the building and no force is required to obtain entry into the premises.

With outside areas of premises, even with trespassers, where trespassers are in occupation of any external areas (e.g. car parks, fields etc) reasonable force can be used.

 

Initially we serve a Legal Notice under the Criminal Justice and Public Order Act 1994, Torts (Interference with Goods) Act 1977 or Common Law to the Trespasser(s) telling them that they need to leave the site.

 

We then re-attend the site within 24 hours and "Evict" the trespassers. We are able to utilize removal vehicles, tractor units and clean up crews if required – please let us know your requirements when calling.
